Buyers! Do you know what you don't know? (Read on and see)
Do you know the sequential steps you need to take in a real estate transaction? You found the home of your dreams online and now you want to see it. Once you are in contact with the Listing Agent or Seller, how do you keep your personal and financial information private, so you retain your buying leverage? How are you going to get through the contract phase of the transaction and write the beneficial contract stipulations that every buyer should have within the agreement? What are those stipulations anyways?
But, if you don't use an agent, you will save money... Right?
There is so much to consider when buying a house. Not only what kind of house you want to buy, but who is going to inspect it? What about the appraisal? How much Earnest Money do you need? What is Earnest Money? Who will finance the transaction? What paperwork do you need to get the financing? If you are lucky enough to win the contract, particularly if there are multiple buyers, what are your timelines for Earnest Money, Due Diligence, Financing and Appraisal? What is at risk if you miss any of your deadlines? Can it cost you money? Or, even worse, can it cost you the deal?
That is the job of your Buyer's Agent. To make sure the answers to these questions are communicated, important processes are followed and to make sure your timelines are observed. Ultimately, the Buyer’s Agent’s job is to make sure you close your transaction protected, at the best price with the lease amount of stress.
But we still have the all-important question, if I don't use an agent, will I save money?
Not using a buyer’s agent doesn’t guarantee you will save money. Matter of fact, unless you are buying a "For-Sale-By-Owner" property, the seller will have a Listing Agent with an agreement to receive a certain percentage of the purchase price. That listing agreement will most likely state the Listing Agent agrees to share a portion of the commission with the Buyer's Agent at closing. If there is no Buyer's Agent, the Listing Agent will receive the entire commission.
What does this mean to you? Do you think the Listing Agent will agree to give up some of their commissions to you so you can buy the house of your dreams? Now factor in, multiple offers.
The risks far out way the possibility of a potential savings. If there is a Listing Agent, you will not have access to the sellers and the Listing Agent will not go out of their way to fight for the price you are offering if it is below the asking purchase price. The Listing Agent is a fiduciary to the Seller. Georgia law expects them to protect the seller and their assets. Now, consider the contract stipulations that should be in your agreement that will protect you from termites, potential failing appliances or even foreign national sellers. Unless you know what stipulations you need and deserve, it is unlikely they will be present in the agreement when you sign your contract.
You don't know what you don't know. As a Buyer, you do not pay the Buyer's Agent unless you have agreed to make up for a missing commission percentage at the closing table. This rarely happens. The Buyer's Agent is a fiduciary to the Buyer. Georgia law expects them to protect the buyer and prevent unnecessary loss of money or benefit if avoidable. The Buyer's Agent protection is almost always free to the Buyer.
